Overview
These Terms & Conditions govern all photography and videography services provided by Christin Theilig, hereinafter referred to as the Photographer. By confirming a booking, the Client agrees to these terms in full. Any amendments must be made in writing and confirmed by both parties.
Project-specific details, including scope of work, fees, deliverables, and licensing duration, are outlined in the individual proposal or agreement provided to the Client.
Scope of Work
The scope of services, including production days, deliverables, and creative direction, will be defined in the signed proposal.
Any additional services or extended production days requested by the Client may be subject to additional fees and must be agreed upon in writing.
Fees & Payment
Payment terms and schedule are specified in the proposal.
Unless otherwise agreed in writing:
- A non-refundable retainer is required to secure booking dates.
- The remaining balance is due prior to final delivery of high-resolution files.
- Payments are made via bank transfer in USD unless otherwise specified.
- The Client is responsible for any international bank or currency conversion fees.
Late payments may accrue interest in accordance with applicable law.
Cancellation & Rescheduling
If the Client cancels a confirmed booking, the retainer remains non-refundable.
If cancellation occurs close to the scheduled production dates, the Client may be responsible for incurred travel, accommodation, or production expenses already committed.
Rescheduling requests will be accommodated where possible, subject to availability.
Copyright & Licensing
All content created by the Photographer remains the intellectual property of the Photographer.
Upon full payment, the Client is granted a commercial license as outlined in the proposal. The license defines permitted usage, duration, and distribution channels.
Unless otherwise agreed in writing:
- The Client may not sell, transfer, sublicense, or redistribute the content to third parties.
- The content may not be materially altered beyond cropping, resizing, or adding branding elements.
- The Photographer retains the copyright and the right to use the content for portfolio, website, editorial features, competitions, and promotional purposes.
- Images may not be altered using AI generation tools or substantially modified in a way that misrepresents the Photographer’s work.
Extended or perpetual licensing may be arranged for an additional fee.
The granted license applies solely to the Client entity named in the agreement. Use by affiliated brands, agencies, tourism boards, or third parties requires prior written approval.
Credit & Attribution
Where reasonably possible, the Client agrees to credit the Photographer when images are used in digital or editorial formats. Absence of credit does not constitute a breach but should be corrected upon request.
Delivery
Final edited content will be delivered digitally within the timeframe specified in the proposal.
The Photographer retains discretion over artistic editing style, color grading, and final image selection.
Raw files are not included unless explicitly agreed upon in writing.
Archiving & File Retention
The Photographer will retain delivered files for a minimum of 6 months. Long-term archiving is not guaranteed unless agreed in writing.
Travel & Production
For destination productions, the Client is responsible for agreed travel, accommodation, access permissions, and logistical coordination as outlined in the proposal.
Production Limitations
The Photographer will make every reasonable effort to capture the agreed scope of content. However, due to variables beyond control including weather, wildlife movement, guest availability, operational changes, or access restrictions, specific shots, individuals, or scenes cannot be guaranteed.
Failure to capture a particular image or moment shall not constitute a breach of the agreement.
Liability
While every effort is made to ensure high-quality delivery, the Photographer’s liability for any claim, loss, or damage is limited to the total fees paid under the agreement.
The Photographer is not liable for indirect or consequential damages, including but not limited to business interruption, marketing performance, or revenue loss.
Insurance Responsibility
The Client is responsible for maintaining appropriate insurance coverage for the property, staff, guests, and production environment. The Photographer maintains their own professional equipment insurance.
Force Majeure
The Photographer is not liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, civil unrest, travel restrictions, pandemics, or technical failures.
In such cases, payments received may be applied toward rescheduled production dates, excluding non-recoverable expenses.
Independent Contractor
The Photographer operates as an independent contractor and retains full creative and operational control over the execution of services.
Model Releases & Permissions
The Client is responsible for obtaining all necessary model releases, property releases, and location permissions for individuals, staff, guests, or third parties participating in the production.
The Photographer shall not be held liable for claims arising from the Client’s failure to secure appropriate permissions.
Governing Law
This agreement is governed by the applicable laws of the Photographer’s country of residence at the time of the agreement.
